Consumer rights panel in Kerala orders boutique to pay ₹58,350 for delayed gown delivery as photoshoot called off

The District Consumer Disputes Redressal Commission in Kollam, Kerala, has ordered a boutique to pay ₹58,350 to a customer after a customised gown intended for a pre-wedding photoshoot was not delivered on time, causing the event to be cancelled.

The order was passed by the commission based on a complaint filed by Jennifer Shah, a resident of Kollam. The legal action was directed against Eha Designs Private Limited, located in Alappuzha, and its Managing Director.

According to the complaint, Jennifer had purchased a specific gown for her upcoming pre-wedding photoshoot. The boutique had promised to make the necessary alterations and deliver the outfit within a stipulated timeframe. However, it failed to deliver the gown by the deadline, forcing the bride-to-be to cancel her scheduled photoshoot entirely.

After carefully examining the evidence and arguments presented in the case, the court observed that there was a clear “deficiency in service” on the part of the boutique. Consequently, the commission ordered the opposite parties to refund the full price of the gown, amounting to ₹23,350.

In addition to the refund, the court directed the boutique to pay ₹25,000 as compensation for the mental agony and disappointment caused to the customer. The opposite parties were also ordered to pay an additional ₹10,000 towards the litigation expenses incurred by the complainant. Advocate M. S. Ajith Kumar represented the complainant in the legal proceedings.
